CMC used that rule to make the 250 GTO.

It's a german law apparently, only applicable in germany.

Wrong. Here you go:Lucky13 wrote:Also wrong.StratosWRC wrote:It's a german law apparently, only applicable in germany.
Copyright laws are international. On top of that European Union laws can not be contradictory when it comes to business practices. And both Italy and Germany are part of that Union.
The only exception are the far east and part of the middle east.
From cmc:
“Please note that the manufacturing and distribution of the suspended scale models does not require any license, in particular not from Ferrari. The model cars are true scale models of original Ferrari cars which were produced more than 25 years ago. Any design which has been published earlier than 25 years ago automatically belongs to the public domain because of the maximum duration of protection of any design registration. Therefore, no authorization is required for the production and distribution of respective scale models.
Please further note that the European Court of Justice (ECJ) and various national courts accordingly (Germany, Spain, Italy etc) ruled that the affixing of a trade mark on scale models in order faithfully to reproduce original cars, and the marketing of those scale models does not constitute a use of the trade mark which the proprietor of the trade mark is entitled to prevent (cf. ECJ, Case C-48/05 – judgment of 25 January 2007, GRUR Int. 2007, 404 – Adam Opel / Autec, copy attached; Federal High Court of Germany, judgment of 14 January 2010 – I ZR 88/08, GRUR 2010, 726 et seq. – Opel Blitz II).
Therefore, it is not justified to ask importers of scale models for authorizations with regard to manufacturer brands or designs older than 25 years.”

Oh and a red line at the front.
Re: [2012 - 2016] AUTOart News
Fully opening 918 is tempting, but agree that it looks kind of off. I like that it has the Weissach Package, though.
Re: [2012 - 2016] AUTOart News
It does look a bit odd, right? It´s good that it has the Weissach package, but when you compare to the Minichamps model (pictured below) which is also equipped with that package. I think we have a clear winner. Hopefully M-champs will release other liveries without the Martini decals.Gavin wrote:Fully opening 918 is tempting, but agree that it looks kind of off. I'd really like a Weissach package, but also don't want a liveried car.
Wheels on the AA look a touch small & they need pulled out more flush with the body work.
Re: [2012 - 2016] AUTOart News
I´m considering getting a Martini car and stripping it of the decals. Should be easy as long as they´re not clearcoated over.Gavin wrote:and the 1:1Emil_SWE wrote:It does look a bit odd, right? Agree 100% on the wheels. Spokes could be a bit thinner as well. Minichamps really nailed this when you compare to the 1:1.

Let us know if that works...would look great in white.
